3 User Responsibilities

By using our services, you agree that you:

  • Are at least 18 years old or have legal authority to engage in real estate transactions. Legal authority may include ownership, power of attorney (POA), trustee designation, executor or administrator appointment, court-issued letters of testamentary or administration, or other legal documentation proving authority to sell or manage property.
  • Will provide accurate and truthful property details.
  • Will not use our services for fraudulent, illegal, or deceptive activities.

We reserve the right to refuse service to anyone suspected of violating these terms.

Our services are not directed toward children under the age of 13. We do not knowingly collect personal information from minors. If you believe we have received information from a child, contact us immediately for removal.

By using our services or submitting any forms, you agree to the use of electronic records and signatures and acknowledge that your consent and agreement are legally binding under the E-SIGN Act.

4 Offer Terms & Property Transactions

  • All cash and creative financing offers are subject to market analysis, underwriting, and due diligence.
  • Submitting a request for an offer does not guarantee an accepted purchase agreement.
  • We reserve the right to withdraw, modify, or decline offers at any time.

Offers are non-binding until all parties execute a formal purchase agreement.

When submitting a request for an offer, please:

  • Complete our online form or contact us directly.
  • Provide full name and contact information.
  • Include the property address and type (single-family, multifamily, etc.).
  • Share known property condition details, including any repair needs.
  • Indicate occupancy status (vacant, owner-occupied, tenant-occupied).
  • Disclose any liens, mortgages, or legal encumbrances.

"Market analysis" refers to our internal review of:

  • Comparable property sales in the area
  • Local market and neighborhood trends
  • Physical property attributes (square footage, year built, lot size, renovations)
  • Current occupancy status and condition

"Underwriting" includes:

  • Risk assessment of the investment
  • Estimated rehab or improvement costs
  • Legal review (title status, liens, tax compliance)
  • Estimated resale value or cash-flow projections

"Due diligence" may include a title check, inspection, financial review, ownership verification, and any required third-party evaluations.

We update offer terms and market insights as needed, based on changes in local real estate conditions, interest rates, or regional trends. Updates to individual offers will be communicated directly via email or phone.

There is no formal dispute or appeal process for declined offers. However, users are encouraged to contact us directly if they believe the decision was based on incomplete or inaccurate information. We may reconsider a declined offer if updated documentation or a revised request is submitted within 15 business days.

If you wish to dispute a finalized transaction or claim against Chief Investment Properties, submit a written request including supporting documents and a detailed explanation to [email protected]. We will confirm receipt within 3 business days and issue a written response within 15 business days. If unresolved, the matter may be escalated through mediation or small claims court in accordance with Georgia law.

If you believe your account has been compromised or that you've been the victim of fraud while using our services, contact us immediately at [email protected] or call 619-252-2009. We will investigate the issue, provide a confirmation of receipt within 3 business days, and notify you of any action taken within 10 business days.

We rely on information provided by sellers, public records, and third-party services and cannot independently verify all submitted data. All offers are made "as-is, where-is" based on the information available at the time.

5 No Real Estate or Legal Advice

Chief Investment Properties is not a licensed real estate brokerage, law firm, or financial advisory service. Any information provided is for informational purposes only and should not be considered legal, financial, or real estate advice.

We recommend consulting a qualified attorney or financial advisor before making any real estate decisions.

6 Communication & Marketing Consent

By providing your contact details (phone number, email, etc.), you consent to receive communications from us, including:

  • Property-related updates and real estate solutions
  • SMS messages, phone calls, emails, and automated or prerecorded messages
  • Marketing or promotional content, if separately opted in

SMS Program:

Chief Investment Properties SMS Program: Real estate updates, property offers, seller resources, and reminders related to real estate solutions.

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.

12 Dispute Resolution

All disputes, claims, or controversies arising out of or relating to these Terms or your use of our services shall be resolved by binding arbitration in Fulton County, Georgia, in accordance with the rules of the American Arbitration Association. Each party shall bear its legal fees. Users waive the right to trial by jury.

The Federal Arbitration Act shall govern this arbitration agreement and shall survive termination of your relationship with us. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction for matters related to intellectual property, unauthorized use, or fraud. If any part of this agreement is found unenforceable, the remaining provisions shall remain in effect.

Users agree to resolve disputes individually and waive any right to participate in class actions or class-wide arbitration.

If any user breach, misrepresentation, or fraud results in reputational, operational, or financial harm to Chief Investment Properties, the Company reserves the right to seek actual, consequential, and statutory damages, including recovery of attorney's fees, expert witness fees, and court costs to the fullest extent permitted by law.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain in full force and effect.
